1. Business Identity, Application and Priority

1.1 These Terms apply to goods and services supplied by Wentao Shen, a sole proprietor carrying on business as ToCraft (“ToCraft,” “we,” “us” or “our”).

1.2 These Terms, the accepted Quote, approved project specifications and any written amendment form the agreement for an order. If they conflict, a written amendment controls first, followed by the accepted Quote and approved specifications, then these Terms.

1.3 The Quote or order confirmation will provide transaction-specific information, including the Customer, description, price, taxes, payment terms, delivery arrangements and supplier contact details required for that transaction. A public quote-request form is an inquiry only and is not an accepted order.

1.4 Nothing in these Terms waives or limits a Consumer right, warranty or remedy that cannot legally be waived or limited.

1.5 The English version governing the order is the version identified in the accepted Quote or order record. A Chinese translation may be provided for convenience, but the corresponding English version controls if there is a discrepancy.

2. Definitions

2.1 “Approved Specifications” means the Customer Files, dimensions, quantity, material, colour, print settings, finish, tolerances, delivery requirements and other requirements expressly accepted in the Quote or later approved in writing.

2.2 “Business Customer” means a Customer acquiring the Services primarily for business, commercial, institutional or professional purposes. “Consumer” means an individual acquiring them primarily for personal, family or household purposes.

2.3 “Customer Files” means files, drawings, measurements, photographs, text, logos, specifications and other material supplied by or for the Customer. “ToCraft Design Files” means CAD, mesh, slicer, support, production and other working files created or modified by ToCraft.

2.4 “Prototype Work” means iterative design or manufacturing work used to test printability, fit, appearance or function. A prototype is not a promise that the requested final result can be achieved within a particular number of attempts or budget unless the Quote expressly says so.

2.5 “Printed Item” means a physical part, prototype, product or other item manufactured by ToCraft. “Quote” includes a written quotation, estimate, proposal or order confirmation issued for a specific project.

2.6 “Critical Application” means a use where failure could reasonably cause death, injury, significant property or environmental damage, regulatory non-compliance or substantial financial loss.

3. Quotes, Acceptance and Order Formation

3.1 A request, uploaded file or discussion does not require ToCraft to accept a project. ToCraft may review manufacturability, intended use, material, risk, capacity and legality before accepting an order.

3.2 Unless the Quote states otherwise, it is valid for 30 calendar days. A validity period printed on the Quote overrides this default.

3.3 An order is formed only after the Customer receives the Quote and these Terms (or a link to the applicable version), expressly approves the Quote, pays any required amount, and ToCraft confirms acceptance for production.

3.4 Approval by signature, email, an accepted electronic method or payment after receipt of the Quote and Terms may constitute acceptance. A person acting for an organization confirms that they have authority to bind it.

3.5 ToCraft will provide or make available a record of the accepted transaction in a form that can be retained by the Customer. Statutory cancellation rights continue to apply where applicable.

4. Service Scope: Print, Design and Prototype Work

4.1 ToCraft provides only the Services and deliverables expressly listed in the accepted Quote. Print Service, CAD Design, Prototype Print and Product Print are separate billable items and may appear together in one project.

4.2 CAD Design may be quoted by design level, estimated hours, fixed scope or another stated basis. Included revisions, file formats, source-file delivery and ownership or licence rights must be stated in the Quote.

4.3 Prototype Work is iterative. Authorized design time, prototype attempts, machine time, materials and third-party costs are chargeable as quoted even when a prototype shows that further changes are required or that the desired result is not commercially feasible.

4.4 ToCraft provides practical manufacturing and design assistance, not professional engineering, certification, regulatory approval, laboratory testing or a guarantee of commercial fitness unless a separate written agreement expressly provides otherwise.

5. Pricing, Taxes and Payment

5.1 Prices may separately identify design time, materials, machine time, quantities, third-party items, delivery and other approved charges. Rates and pricing assumptions are those stated in the accepted Quote.

5.2 For material-based pricing, slicer-reported total consumption may include the model, supports, support interfaces, rafts, brims, purge or flushing material, prime towers and other process material. Machine time may include the full slicer-reported production time.

5.3 Prototype Print is not subject to the CAD 15 minimum print charge. The Product Print portion of an order is subject to a CAD 15 minimum in aggregate, not a separate CAD 15 minimum for every small part or line item.

5.4 Prices are in Canadian dollars unless stated otherwise. GST is added at the applicable rate (currently 5%). ToCraft GST No.: 76184 2038 RT0001.

5.5 Unless the Quote states otherwise, Personal orders are payable before production. Business orders may use deposits, milestones or credit terms stated in the Quote or Invoice. ToCraft may delay purchasing, production, file release or delivery until required payments clear.

5.6 e-Transfer payments may be sent to info@tocraft.ca using the instructions on the Invoice. Customers must not send payment-card numbers or banking credentials by ordinary email.

5.7 If ToCraft offers credit-card payment and applies a surcharge, the surcharge will be disclosed before payment, shown on the receipt and will not exceed the lower of ToCraft’s permitted card-acceptance cost and the applicable card-network or legal maximum. A surcharge will not be applied where prohibited, including to a payment type that may not lawfully or contractually be surcharged.

5.8 Title to a Printed Item remains with ToCraft until the applicable order is paid in full. This does not limit a statutory right that applies before or after payment.

6. Changes, Feasibility and ToCraft’s Right to Pause or End Work

6.1 Customer-requested changes after approval may require a revised Quote, additional design or prototype fees, payment for completed work and materials, and a revised schedule. ToCraft will obtain approval before performing materially different or additional work or increasing an estimate beyond an amount permitted without further consent by applicable law.

6.2 ToCraft may make minor production adjustments such as orientation, supports, seam placement, infill pattern and part arrangement when reasonably necessary and when they do not materially change the Approved Specifications.

6.3 ToCraft may pause, refuse or terminate work if the project repeatedly fails, cannot reasonably be printed within the approved conditions or budget, creates unacceptable safety or legal risk, exceeds available equipment or material capability, or the Customer declines a reasonably necessary measure such as supports, slower printing, a different orientation, material, tolerance, geometry or prototype stage.

6.4 Where reasonably practical, ToCraft will explain the issue and offer one or more options: revise the specifications, approve a revised price or prototype stage, accept completed work, or end the remaining work. ToCraft is not required to continue work at an unapproved loss or to make unlimited production attempts.

6.5 If work ends, the Customer remains responsible for authorized design work, authorized prototype or production attempts, consumed or specially purchased materials and non-recoverable expenses. ToCraft will refund any unearned prepaid amount. Unapproved repeat attempts caused solely by ToCraft’s production error will not be charged to the Customer.

7. Customer Files, Measurements and Approval

7.1 The Customer is responsible for the completeness, scale, dimensions, clearances, intended use and accuracy of Customer Files and Customer-provided measurements.

7.2 The Customer must review drawings, renderings, dimensions, proofs, prototypes, photographs and specifications. Approval authorizes manufacture according to the Approved Specifications.

7.3 ToCraft may identify obvious printability concerns but is not required to discover hidden geometry, design errors, inadequate strength, interference, poor tolerancing or unsuitable operating conditions.

7.4 Any guaranteed dimension, fit, colour, finish, tolerance, performance or inspection method must be expressly stated in the accepted Quote.

8. As-Printed Delivery and Excluded Work

8.1 Unless the Quote expressly includes additional finishing, Printed Items are delivered As-Printed: in the condition produced by the agreed additive-manufacturing process.

8.2 Excluded work includes support, raft and brim removal; sanding, filing, polishing and cosmetic cleanup; filling, coating, painting and colour matching; drilling, tapping, machining and precision fitting; insert, magnet, electronic or hardware installation; bonding, assembly and installation; scanning, reverse engineering, file repair and format conversion; engineering analysis, testing, certification and inspection documentation; and any other service not listed in the Quote.

8.3 If support removal is not included, supports, support interfaces, rafts, brims, prime towers and other process structures may be delivered with the Printed Item.

9. FDM Characteristics, Tolerances and Fit

9.1 FDM/FFF manufacturing builds thermoplastic parts in layers. Normal characteristics may include visible layer lines, seams, support-contact marks, minor stringing, small blobs, surface and gloss variation, shrinkage, warping, elephant foot, bridging variation, build-plate marks, batch variation and direction-dependent strength.

9.2 These characteristics are not defects when commercially reasonable for the selected process and when the Printed Item materially conforms to the Approved Specifications.

9.3 No general dimensional or fit guarantee applies unless the Quote states a tolerance and acceptance method. Holes, threads, snap fits, friction fits and mating parts may require test prints, reaming, tapping, finishing or iterative adjustment.

9.4 A fit or clearance assurance applies only when expressly quoted and when the relevant mating parts are printed by ToCraft together under the approved material, settings and validation process. Using the same material alone does not create a fit guarantee.

9.5 Fit to an injection-moulded, cast, machined, purchased or Customer-existing component is not guaranteed unless ToCraft receives reliable verified dimensions or the actual mating component and the Quote includes prototype or fit testing. Multiple authorized prototypes may be necessary and are separately chargeable.

9.6 Printed Items are not represented as airtight, watertight, pressure-tight or vacuum-tight unless expressly tested and accepted under a written project-specific requirement.

10. Materials, Colour and Intended Use

10.1 Material and colour are selected as stated in the Quote. Colour names are descriptive; exact shade, gloss and batch matching are not guaranteed unless expressly quoted. Different colours of the same material normally use the same material rate unless the Quote states otherwise.

10.2 General material information is manufacturing guidance, not a performance warranty. Raw-filament datasheet values do not necessarily represent the finished Printed Item because properties vary with colour, moisture, geometry, thickness, infill, orientation, settings, environment and aging.

10.3 The Customer must disclose relevant load, temperature, sunlight, chemical, electrical, food, water, child-safety, installation and regulatory conditions. The Customer is responsible for controlled testing and appropriate professional review before use.

11. Prohibited and Restricted Orders

11.1 The Customer must not request an unlawful item, an infringing use of third-party rights, a functional firearm, weapon or component primarily intended to cause injury, an item intended to defeat safety or access controls, harmful or exploitative content, or any order creating an unacceptable safety, legal, ethical or reputational risk.

11.2 Non-functional costume, display or cosplay props may be considered only after review and must not be designed or represented as functional weapons.

11.3 Unless separately reviewed and accepted in writing, Printed Items are not certified or approved for Critical Applications, including life-safety, medical, personal protective, transportation-safety, pressure, lifting, climbing, structural human-support, mains-voltage, fire-protection, young-child, food-contact or potable-water uses.

11.4 ToCraft may refuse, suspend or cancel a restricted order. Acceptance or successful manufacture does not constitute legal, safety, engineering or regulatory approval.

12. Intellectual Property, Design Files and Publicity

12.1 The Customer represents that it owns or has permission to use and authorize manufacture from each Customer File. The Customer grants ToCraft a limited licence to store, copy, modify for manufacturability, slice and use Customer Files only as reasonably required to quote, produce, inspect, deliver and maintain necessary order records.

12.2 Customer-owned intellectual property remains the Customer’s property. ToCraft retains its brand, pre-existing files, templates, libraries, workflows, know-how and production methods.

12.3 Unless the Quote expressly provides a written transfer, ToCraft retains ownership and copyright in ToCraft Design Files and may reuse, adapt, license or sell ToCraft-created designs. Payment for design time alone does not transfer copyright, exclusivity or source files.

12.4 A transfer must identify the files delivered, ownership or licence granted, permitted uses, exclusivity, resale and modification rights, delivery format and price. The Customer receives only the rights expressly stated in the Quote; otherwise it receives a non-exclusive licence to use the delivered Printed Item for the disclosed purpose.

12.5 ToCraft’s reuse or resale rights do not authorize disclosure of the Customer’s identity, confidential information, trademarks or Customer-owned files, and remain subject to applicable third-party rights.

12.6 ToCraft will not publish identifiable custom work, Customer names or confidential project information for marketing without written permission, unless the material is already public and lawfully usable.

13. Cancellation, Schedule and Delivery

13.1 A Customer requesting cancellation must notify ToCraft in writing. After work begins, the Customer is responsible for authorized work performed, authorized machine attempts, consumed or specially purchased materials and non-recoverable costs. Custom-made work is not returnable solely because the Customer changes its mind, except where law requires otherwise.

13.2 If ToCraft cancels for a reason not caused by the Customer, ToCraft will refund the unearned portion of payments received. If cancellation results from Customer restrictions, refusal of necessary changes, inaccurate specifications, prohibited use or breach, clause 6.5 applies.

13.3 Production and delivery dates are estimates unless expressly guaranteed in writing. Lead time begins after final files, approvals, information and required payment are received.

13.4 Pickup, local delivery, courier and shipping arrangements and charges are those stated in the Quote. Risk transfers as permitted by applicable law and the agreed delivery method. The Customer must promptly report visible shipping damage and preserve relevant packaging and evidence.

14. Pickup and Uncollected Custom Items

14.1 ToCraft will send a ready-for-pickup notice and pickup instructions. The Customer should collect the order within 14 calendar days.

14.2 ToCraft is not a storage service and does not charge a routine storage fee. If a custom item remains uncollected for 30 days after the ready notice, ToCraft may send a final written notice allowing at least 7 additional days for collection.

14.3 If the Customer does not collect after that final period, the Customer authorizes ToCraft, to the extent permitted by law, to recycle or dispose of a custom item that has no reasonable resale value. Disposal does not cancel payment owed for completed custom work. Items with material resale value, unclaimed funds or other legal restrictions will be handled as applicable law requires.

14.4 Specific residential pickup details may be provided only to a confirmed Customer for privacy and security. The Customer is responsible for safe transport after pickup.

15. Inspection, Non-Conformance and Remedy

15.1 The Customer should inspect Printed Items promptly and notify ToCraft in writing within 7 calendar days of receipt or pickup of an incorrect quantity, material or colour, visible damage, or material failure to meet the Approved Specifications. This requested notice period does not eliminate a non-waivable statutory right.

15.2 The notice should include the order number, explanation, photographs and reasonable measurements. ToCraft may request return or inspection of the affected item.

15.3 If ToCraft confirms a material non-conformance caused by its production error, ToCraft may repair, reprint, replace, adjust the price or refund the amount paid for the affected item, as appropriate and subject to applicable law.

15.4 A remedy is not normally available for Customer design or measurement errors, an unsuitable Customer-approved material, normal FDM characteristics, an unquoted fit or performance expectation, damage after delivery, improper installation or use, or an undisclosed operating condition.

16. Confidentiality, Privacy and File Retention

16.1 ToCraft will collect, use and disclose personal information only for reasonable business purposes such as quoting, communication, production, payment, delivery, records, warranty, security and legal compliance, and will use reasonable safeguards appropriate to the information.

16.2 Standard service does not create a separate non-disclosure agreement. A Customer requiring heightened confidentiality must arrange an acceptable written NDA before submitting sensitive information.

16.3 ToCraft may use reasonable third-party email, cloud storage, payment, shipping and production services. The Customer should not send passwords, full payment-card details, banking credentials, regulated health information or unnecessary sensitive personal information.

16.4 Customer and working files will normally be deleted from active project storage within 30 days after an order is completed or cancelled, unless a longer period is reasonably required for a dispute, warranty, safety, legal or expressly agreed purpose. Routine backups may retain copies until overwritten through the normal backup cycle.

16.5 Invoices, receipts, tax records and other records required for legal or business purposes may be retained for the applicable retention period. ToCraft is not an archival service, and the Customer must keep original and backup copies of all Customer Files.

16.6 Privacy questions or requests may be directed to info@tocraft.ca. Marketing use remains subject to clause 12.6.

17. Responsibility and Limitation of Liability

17.1 The Customer is responsible for determining suitability, controlled testing, competent installation, maintenance and safe use. The Customer must stop using a Printed Item that is cracked, deformed, delaminated, damaged, excessively worn or otherwise appears unsafe.

17.2 To the maximum extent permitted by law, ToCraft is not liable for indirect, incidental, special, punitive or consequential loss, or for loss caused by Customer Files, undisclosed use, Customer-approved material, improper installation, unauthorized modification, misuse, operation beyond disclosed conditions, or integration into another product or system.

17.3 Subject to non-excludable rights, ToCraft’s aggregate liability relating to an affected order will not exceed the amount paid for the affected Printed Item or Service. Nothing excludes liability where exclusion is prohibited, including applicable liability for fraud, wilful misconduct, gross negligence or personal injury that cannot lawfully be excluded.

17.4 To the extent permitted by law, a Business Customer will indemnify ToCraft against third-party claims arising directly from infringing Customer Files, an unlawful order, materially inaccurate Customer specifications, unsafe modification or integration, or the Business Customer’s resale or distribution without appropriate warnings. This indemnity does not apply to a Consumer except to the extent a specific obligation is legally enforceable.

18. Force Majeure, Communications and General Terms

18.1 Neither party is responsible for reasonable delay caused by events beyond its control, including severe weather, fire, flood, power interruption, equipment failure despite reasonable maintenance, labour disruption, government action, transportation interruption or material shortage. The affected party will take reasonable steps to reduce the effect.

18.2 Order-related communications may be sent to the contact information provided by the Customer. Marketing communications are separate and may be declined as required by law.

18.3 These Terms are governed by Alberta law and applicable federal Canadian law. The parties will first attempt good-faith written resolution, without preventing a Consumer from using a court or complaint process available by law.

18.4 If a provision is invalid or unenforceable, it will be limited or severed only as necessary and the remainder continues. Failure to enforce a provision once is not a waiver. Amendments to an accepted order must be agreed in writing.

18.5 ToCraft may update these Terms for future orders. An update does not retroactively change an order already accepted unless both parties agree or law requires otherwise. The applicable version is identified by version number and effective date.

18.6 Questions and notices may be sent to info@tocraft.ca. Transaction-specific address and telephone information will be provided in the applicable Quote, order confirmation or Invoice where required.

19. Customer Acknowledgement

By accepting the Quote, the Customer confirms that it has reviewed the scope, specifications, pricing and included or excluded services; disclosed the intended use and relevant conditions; understands normal FDM and As-Printed characteristics; has authority to use submitted files; understands the applicable design-file rights and retention policy; and accepts these Terms, Version 2.0.
